GENERAL PROVISIONS
These terms and conditions (the Terms) set out the procedure according to which you, in order to assess the possibility of concluding a contract of purchase of wood products offered by Degmeda, UAB, the legal entity code 304895414, the address of the registered office J. Šimkaus str. 19, Garliava, LT-53204 Kaunas district (the Degmeda), can get the samples of the wood products offered by it (the Samples), and you can also use the Degmeda’s Internet website – www.degmeda.eu (the Website).

Ordering Samples on the Website and in accordance with these Terms forms part of the pre-contractual relationship between you and Degmeda in order for you to assess the possibilities of concluding a contract for the purchase and sale of wood products offered by Degmeda. The Samples are not goods and have no other purpose and may not be used for any purpose other than to evaluate Degmeda’s wood production, to select a species or shade.
In a pre-contractual relationship, the parties are free to enter into negotiations and bargain and are not liable for any failure to reach an agreement. Therefore, the ordering of Samples does not create an obligation for you to enter into a purchase and sale agreement with Degmeda and to purchase Degmeda’s wood products, or for Degmeda to enter into a purchase and sale agreement with you or to sell its wood products to you.
However, as the Degmeda will select the Samples of your choice, prepare them, pack them, and take care of their delivery to the address specified by you, the Degmeda will incur related costs. You are therefore only entitled to order Samples if you have the capacity to enter into a binding agreement with the Degmeda under the applicable laws and agree to comply with these Terms and the applicable laws. If you are under 18 years of age, you may only order Samples with the consent of your parents or other legitimate representatives. By ordering Samples, you confirm that you are 18 years of age or older or have the consent of your parents or other legitimate representatives or the right to represent the legal entity on whose behalf you are ordering Samples.
ORDERING SAMPLES
Once you have selected the Samples you are interested in (a maximum of 4 Samples can be ordered), a Samples order basket is created on the basis of this selection.
Once the basket has been created, you will need to enter the details necessary for the delivery of the selected Samples. Please make sure that the details you have provided are correct and that the Samples you are ordering are in accordance with your preferences. You have the opportunity to correct errors, if any, before confirming the order of Samples. The data you provide will be processed for the purposes and in the manner set out in the Privacy Policy.
By placing an order for Samples, you undertake to pay an ordering fee of EUR 25 (twenty-five euros). If you subsequently enter into a purchase and sale agreement of wood products with Degmeda, the Samples order fee will be credited as part of the price of the Degmeda products purchased by you (i.e. the price of the products purchased by you will be reduced by the Samples order fee paid).
You can pay the Samples ordering fee using the following methods: e-banking, credit card, Apple Pay.
Payment must be made immediately after placing the Samples order.
Degmeda will start preparing the Samples for dispatch to you as soon as it receives confirmation from the payment service provider of the payment of the Samples order fee.
After placing the Samples order, an e-mail will be sent to the e-mail address specified by you, indicating the ordered Samples and the data provided by you.
DELIVERY OF SAMPLES
When ordering Samples, you must choose the method of delivery of yours and indicate the delivery address of the Samples. Degmeda takes care of the delivery of Samples by using delivery service providers.
INTELLECTUAL PROPERTY
The trademarks and logos designating the Samples and used on the Website, the domain name, the Samples themselves and the Website, as well as all individual elements thereof, including the text, photographs, drawings and all materials contained on the Website, the presentation, image and design of any page of the Website and all intellectual property rights therein are the exclusive property of Degmeda and/or others. You undertake not to copy, modify, or otherwise use these intellectual property items without the express written consent of the rights holder.
MODIFICATION AND DISCONTINUATION
Degmeda may change these Terms from time to time. The latest (valid) version of the Terms will always be visible and available on the Website. Before confirming the order of Samples, you must familiarize yourself with the current version of the Terms. Each Samples order will be subject to the version of the Terms that was in force at the time of placing such an order.
MISCELLANEOUS
The laws of the Republic of Lithuania will apply to the execution and interpretation of these Terms.
Any dispute, disagreement or claim arising out of, or in connection with, these Terms or any sale and purchase agreement concerned (including any breach, termination, or validity of the same) shall be settled by negotiation. If the parties fail to agree, disputes shall be settled in accordance with the laws of the Republic of Lithuania. If you are a consumer, the subject of out-of-court settlement of consumer disputes, which is competent to resolve consumer disputes arising from these Terms, is the State Consumer Rights Protection Authority (address: Vilniaus g. 25, LT-01402 Vilnius, tel. +37052626751, e-mail [email protected]; website http://www.vvtat.lt) or http://ec.europa.eu/odr/.
All notices and other communications relating to the ordering of Samples and to these Terms will be delivered via email (if to the Degmeda – at the email address indicated above, and if to you – at the email address provided at the time of ordering).
If any provision of these Terms is or becomes invalid (either in whole or in part) that will not affect the validity of the remaining provisions.
